29 CFR  1910.178(p)(1):If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition.  On or about August 9, 2023 at location 209 North 4th Avenue, Saint Nazianz, Wisconsin: employees operating powered industrial trucks with damage including, but not limited to, chunks of tire missing, severe splitting of tire sidewalls and tires pulling away from the rims.  a. 0001196 - Toyota (Model: 5FBE20 Serial: 11167) forklift was operated with damaged tires. Damage to the tires was found to include, but was not limited to, chunks of tire missing, severe splitting of sidewalls and tires pulling away from the rims, which could result in the tires to lose traction and possibly expose forklift operators to tip-over hazards.  b. 000862 - Yale (Model: 36v Only) forklift was operated with damaged tires. Damage to the tires was found to include, but was not limited to, chunks of tire missing, severe splitting of sidewalls and tires pulling away from the rims, which could result in the tires to lose traction and possibly expose forklift operators to tip-over hazards.  c. 0001197 - Yale (Model: ESCO25ABN24SE083 Serial: A824N06066T) forklift was operated with damaged tires. Damage to the tires was found to include, but was not limited to, chunks of tire missing, severe splitting of sidewalls and tires pulling away from the rims, which could result in the tires to lose traction and possibly expose forklift operators to tip-over hazards.  d. 984 - Toyota (Model: 8FGU25 Serial: 12413) forklift was operated with damaged tires. Damage to the tires was found to include, but was not limited to, chunks of tire missing, severe splitting of sidewalls and tires pulling away from the rims, which could result in the tires to lose traction and possibly expose forklift operators to tip-over hazards.  e. 0001304 - Toyota (Model: 8FGU25 Serial: 39956) forklift was operated with damaged tires. 29 CFR  1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.  On or about August 9, 2023, at location 209 North 4th Avenue, Saint Nazianz, Wisconsin: employees operated Toyota powered industrial trucks with damaged to include, but not limited to, worn tires, tires with radial cracks, and tires pulling away from the rim. The employer did not remove forklifts from service or correct deficiencies. Employees were not conducting inspections prior to use.   a. 0001196 - Toyota (Model: 5FBE20 Serial: 11167) forklift was operated with damaged tires. Damage to the tires was found to include, but was not limited to, chunks of tire missing, severe splitting of sidewalls and tires pulling away from the rims, which could result in the tires to lose traction and possibly expose forklift operators to tip-over hazards.  b. 000862 - Yale (Model: 36v Only) forklift was operated with damaged tires. 29 CFR  1910.151(c):Where the eyes or body of any person may be exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body shall be provided within the work area for immediate emergency use. [63 FR 33450, June 18, 1998]  On or about August 9, 2023 at location 209 North 4th Avenue, Saint Nazianz, Wisconsin: employer did provide a suitable facility for quick drenching or flushing of the eyes for immediate emergency use where employees add water to Lead Acid Battery that contains Sulfuric Acid, thus exposing employees to potential chemical burn hazard to the eyes.

On or about August 9, 2023 at location 209 North 4th Avenue, Saint Nazianz, Wisconsin: the employer failed to keep clear an unobstructed path of at least three feet (36 inches) in front of electrical panelboards.   a) Maintenance shop: electrical panel that controls the north side of the building was blocked with material and equipment.  b) Maintenance shop: electrical panel that controls the south side of the building was blocked with material and equipment.
