29 CFR 1926.501(b)(1):"Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) On or about 08/17/2023, during the erection of a commercial building , located on 140 South Union Street, in Spencerport, New York, the employer did not enforce the use of fall protection when employees were constructing the building framework of the upper floor joist and subflooring. Employees were allowed to work along unprotected sides, 14 feet above lower levels, without fall protection and were exposed to fall hazards. NO ABATEMENT CERTIFICATION REQUIRED

1926.1060(b) Retraining shall be provided for each employee as necessary so that the employee maintains the understanding and knowledge acquired through compliance with this section. [55 FR 47691, Nov. 14, 1990] 29 CFR 1926.1053(b)(13):The top or top step of a stepladder shall not be used as a step. a) On or about 08/17/2023, during the erection of a commercial building , located on 140 South Union Street, in Spencerport, New York, the employer did not enforce the safe use of portable ladders. Employees were allowed to use the top step of an 8 ft. portable A Frame ladder , to gain access to an upper level during the construction of the building. NO ABATEMENT CERTIFICATION REQUIRED
