29 CFR  1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  a)	370 George Patterson Blvd. Bristol, PA:  On or about August 23, 2023, employee(s) used a pneumatic jackhammer without a continuous water delivery system located at the point of impact as required by Table 1. Employee(s) were performing demolition work on materials containing silica on the outside facade of the building without the use of respiratory protection.

29 CFR  1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a) 370 George Patterson Blvd. Bristol, PA - On or about August 23, 2023, two employees were working on a concrete canopy approximately 20 feet above the ground without the use of fall protection.  Pedro Palmer Construction, Inc. was previously cited for a violation of an equivalent Occupational Safety and Health Standard 1926.501(b)(13), which was contained in OSHA inspection number 1617528, citation number 1, item number 1 and was affirmed as a final order on 5/22/2023 with respect to a workplace located at 3344 N 22nd Street, Philadelphia, PA 19140.
