OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On or about September 15, 2023, at a worksite located at 1500 NE Pink Hill Road, Blue Springs, MO: The employer exposed an employee to the recognized fire and explosion hazards associated with leaking propane gas. The employer sent an employee to respond to a report of a gas leak at a customer home. The employee made a repair to a broken gas line that fed propane from the tank outside into the home. The employee then entered the home's basement to light the pilot light on the hot water heater. As he did so, propane gas accumulated in the basement ignited and exploded, injuring the employee.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): At a worksite located at 1500 NE Pink Hill Road, Blue Springs, MO: Employees were exposed to fire and explosion hazards. This was last demonstrated on or about September 15, 2023, and at times prior thereto, when workers were engaged in liquid petroleum gas (propane) activities including but not limited to residential properties. The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). Employees responding to calls of service were not provided with and or required to wear clothing which was flame-resistant or made of 100% cotton during the performance of the duties. Employees were exposed to fire and explosion hazards when working with propane gas which can or has the potential to accumulated in the work area(s).

29 CFR 1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical: At a worksite located at 1500 NE Pink Hill Road, Blue Springs, MO: Employees were exposed to fire and explosion hazards. This was last demonstrated on or about September 15, 2023, and at times prior thereto, when employees were engaged in liquid petroleum gas (propane) activities including but not limited to residential properties. Employees responding to calls of service including gas leak(s) were not provided with all necessary information including, but not limited to a product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals. The employer failed to ensure that at 500-gallon tank containing liquefied petroleum gas (LP-Gas, LPG, Propane) was not labeled as to its contents or provided necessary physical or health hazards. Employees were exposed to fire and explosion hazards when working with propane gas which is a flammable gas.
