29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed:  On or about September 20, 2023 the employer did not ensure periodic inspections of the energy control procedures were completed at least annually. Employees working on the Niagara 1600 ton press (serial number P52904) are required to change out dies, service dies and set up the press for operations which requires energy control procedures that have not been reviewed for deficiencies thereby exposing employees to struck by and crushing hazards.

29 CFR 1910.147(c)(5)(i): Locks, tags, chains, wedges, key blocks, adapter pins, self-locking fasteners, or other hardware were not provided by the employer for isolating, securing, or blocking of machines or equipment from energy sources:  On or about December 1, 2023, the employer did not ensure that die blocks were available on the Niagara 1600 ton press, serial number P52904, for blocking of the machine to control gravitational energy sources. Employees were exposed to stuck by and crushing hazards.

29 CFR 1910.147(c)(7)(i)(A): The employer did not provide training to authorized employee(s) on the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control:  a) On or about September 20, 2023, the employer did not ensure die setters and press operators tasked with die and coil setting on the Niagara 1600 ton press, serial number P52904, were provided with authorized employee LOTO training covering the hazardous energy sources, the type and magnitude of the energy, and methods and means for energy isolation and control.   b) On or about September 20, 2023, the employer did not ensure tool room employees tasked with making die repairs and adjustments such as but not limited to sharpening details and punches or adjusting shims on the Niagara 1600 ton press, serial number P52904, were provided with authorized employee LOTO training covering the hazardous energy sources, the type and magnitude of the energy, and methods and means for energy isolation and control.

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):   a) On or about September 20, 2023, the employer did not ensure that the company's energy control procedures were utilized to control hazardous mechanical movement of the Niagara 1600 ton press, serial number P52904, when die setters and press operators conducted activities such as, but not limited to die and coil setting exposing employees to struck by and crushing hazards.   b) On or about September 20, 2023, the employer did not ensure that the company's energy control procedures were utilized to control hazardous mechanical movement of the Niagara 1600 ton press, serial number P52904, when tool room employees conducted activities such as, but not limited to sharpening die details and die punches or adjusting shims on the die exposing employees to struck by and crushing hazards.   Toledo Tool & Die Company, Inc.  was previously cited for a violation of this occupational safety and health standard 29 CFR 1910.147(d), which was contained in OSHA inspection number 1303653, citation number 1, item number 1B and was affirmed as a final order on November 21, 2019, with respect to a workplace located at 105 West Alexis Road, Toledo, Ohio 43612.
