29 CFR  1926.20(b)(1): The employer failed to initiate and maintain such programs as may be necessary to comply with the prevention of accidents at their worksite.  On or about September 21, 2023 the employer did not have a program in place to identify hazards found in the job site. This program assists employees in maintaining a safe working environment by identifying potential hazards they can encounter in their tasks including, but not limited to, falls from the roof during jobsite roofing operations.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  On or about September 21, 2023, the employer, working at the address of 255 W Lakeshore Drive in Port Clinton, Ohio 43452, did not ensure their employees had been properly trained on how to use appropriate fall protection systems including but not limited to a guardrail system, safety net system, personal fall arrest system, or alternative fall protection measures while conducting roofing operations including but not limited to placing shingles and other roofing material on the roof of a commercial building serving as a hotel.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  On or about September 21, 2023, the employer, working at the address of 255 W Lakeshore Drive in Port Clinton, Ohio 43452, did not ensure their employees were protected from fall hazards using a guardrail system, safety net system, personal fall arrest system, or an alternative fall protection measure. Employees were removing and securing shingles and additional roofing material to the roof of a three story commercial building, or hotel, without the use of fall protection, exposing employees to falls hazards of  over 25 feet.  Good Guys Roofing, LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1563326, citation number 1, item number 2 and was affirmed as a final order on December 13, 2021, with respect to a workplace located at 607 Pine Valley Lane in Toledo, Ohio 43615.  Good Guys Roofing, LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1615770, citation number 2, item number 1 and was affirmed as a final order on October 5, 2022, with respect to a workplace located at 1501 Pray Boulevard in Waterville, Ohio 43566.  Good Guys Roofing, LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1690013, citation number 2, item number 1 and was affirmed as a final order on September 19, 2023, with respect to a workplace located at 595 Sterns Road in Fostoria, Ohio 44830.
