OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to burn hazards from overflowing hot liquid:  a)  Continuous Room - On or about September 26, 2023, an employee was exposed to falling hot liquid from an overflowing sedimentor tank in that the employer failed to ensure that their processes accounted for the level of material in the tank and the possibility of displacement.  Among other methods, feasible and acceptable means of abatement include, but are not limited to:  1)  Add a process to verify the tank level prior to introducing air, water, steam or other material into the tank.  2)  Add an audible and/or visual high-level alarm or other warning device to indicate that the liquid in the tank is not to be agitated.  3)  Ensure employees don appropriate PPE, including gloves, safety glasses, gloves, long sleeves, and appropriate clothing to protect against steam and potential splashes.  4)  Confirm that all employees in the area are aware of the procedure and maintain a safe distance from the tank during the process.
