29 CFR  1910.178(l)(1)(ii):Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).  On or about October 4, 2023, the employer did not ensure the Powered Industrial Truck (PIT) operator had successfully completed the required training prior to operating the PIT, exposing employees to struck-by hazards.   Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.503(a)(1):The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  On or about October 4, 2023, employees performing residential construction activities at heights exceeding six feet were not trained to recognize and minimize fall hazards, exposing the employees to falls of approximately 20  feet.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.100(a):Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.  On or about October 4, 2023, employees were not wearing hard hats while working in an area where overhead hazards existed, exposing employees to struck-by hazards.  The P & D Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.100(a) which was contained in OSHA inspection number 1452693, citation number 1, item number 1 and was affirmed as a final order on April 8, 2020, with respect to a workplace located at Lot 1 - Sage Brush Lane Country Pond Estates, Mokena, IL 60448.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  On or about October 4, 2023, employees performing residential construction activities at heights exceeding six feet were not protected from falls, exposing the employees to falls of approximately 20  feet.  P & D Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1534072, citation number 1, item number 2 and was affirmed as a final order on October 29, 2021, with respect to a workplace located at 12 County Line Road Hinsdale, IL 60521.  P & D Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1452693, citation number 2, item number 1 and was affirmed as a final order on April 8, 2020, with respect to a workplace located at Lot 1 - Sage Brush Lane Country Pond Estates Mokena, IL 60448.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
