29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a - 102 Vaughn Drive, West Windsor NJ: While installing a fascia board onto the outer edges of roof trusses, and performing other related activities, a worker was not protected from falling when walking and working from the top plates of a residential structure's outer wall frames while wearing a full body harness that was not connected to an anchor with a lanyard or other approved means. As such this worker was exposed to fall hazards in excess of 25 feet to the ground below. Condition noted on or about 10/12/23. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level: a- 102 Vaughn Drive, West Windsor NJ: A worker performing fascia board installation, and other related activities, while working and walking from a residential structure's outer wall top plates was not protected from falling while wearing a full body harness whose attached lanyard's anchor point consisted of the lanyard being wrapped around a wooden roof trusses' interior chords and its metal connection plate. The end of this lanyard was knotted back to itself. As such, this worker was exposed to fall hazards in excess of 25 feet to the ground below. Condition observed on or about 10/12/23. b- 102 Vaughn Drive, West Windsor NJ: A worker performing fascia board installation, and other related activities, while working and walking from a residential structure's outer wall top plates was not protected from falling while wearing a full body harness whose attached lanyard's anchor point consisted of the lanyard being wrapped around the top chord of a wooden roof truss. The end of this lanyard was knotted back to itself. As such, this worker was exposed to fall hazards in excess of 25 feet to the ground below. Condition observed on or about 10/12/23. 29 CFR 1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii) a - 102 Vaughn Drive, West Windsor NJ: Workers performing fasica board installation and other related activities while walking and working from the top plates of a structure's inner and outer wall frames were not trained on fall protection means and methods as specified in 29 CFR 1926.503 (a)(2)(i) through (viii). These workers were exposed to fall hazards, up to and in excess of 25 feet, while their full body harnesses were either improperly anchored or not attached to anchors at the worksite. Condition noted on or about 10/12/23. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.
