29 CFR 1926.1051(a): Stairways or ladders were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist was provided: a- Building 6 - Parker Boulevard, West Windsor NJ: A worker working and walking from the top plates of a residential structure's wooden wall frames was exposed to fall hazards up to and in excess of 9 feet 1 inch to the concrete flooring below when accessing to and egressing from these top plates using the structural members of the wooden wall frames. The break in elevation from these top plates to/from the structural member was greater that 19 inches. Condition noted on or about 06/10/24. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a - Building 6 - Parker Boulevard, West Windsor NJ: A worker was exposed to fall hazards when performing framing and other related activities while walking and working from the top plates of a residential structure's outer wall frames without fall protection. As such this worker was exposed to fall hazards in excess of 10 feet 3 inches to the ground below. Condition noted on or about 06/10/24. Morente Construction, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1703085, citation number 1, item number 1 and was affirmed as a final order on January 25, 2024, with respect to a workplace located at 102 Vaughn Drive in West Windsor NJ. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
