29 CFR  1910.178(l)(6):Certification. The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation.  On or about October 18, 2023 the employer failed to ensure the employees operating the Lull 644E-42 telehandler had documented training.  The telehandler was being operated to raise supplies to the work area of a new residential structure.  Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR  1926.1052(c)(1)(i):Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail:  On or about October 18, 2023 the employer failed to ensure the stairs going from the first level to the second level of a new residential dwelling had a hand rail for the first five risers.  This exposed the employees that were engaged in residential framing activities to fall hazards.  Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  On or about October 18, 2023 the employer did not ensure that employees who were engaged in residential construction activities were protected from fall hazards.   Employees were exposed to falls in excess of 6 feet to the ground below while performing roof decking activities.  The employees were actively engaged in the installation of sheathing on the ne residential dwelling.   EAN Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1611233, citation number 1, item number 1 and was affirmed as a final order on October 25, 2022, with respect to a workplace located at Lot 155 Northwind Dr., Sandwich, IL 60548.  Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).
