29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury:  a. Employees performing framing work are not protected from eye injuries while using pneumatic nail guns.  The employer fails to assure effective protections against eye and face injuries as required by the standard, as demonstrated on October 18, 2023, when employees are working on a residential framing construction at 7155 Mahogany Run Drive, lot 24, in Jacksonville, Florida, without eye protection while using pneumatic nail guns and are exposed to eye injuries from flying debris or nails.    Ya Olivas Construction, Inc. was previously cited for a serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1658021, citation number 01, item number 001 and was affirmed as a final order on May 26, 2023, with respect to a workplace located at 107 Canopy Forest Drive, Lot 69, Saint Augustine, FL 32086.  Ya Olivas Construction, Inc. was previously cited for a serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1655334, citation number 01, item number 001 and was affirmed as a final order on May 26, 2023, with respect to a workplace located at 394 Navigators Road, Jacksonville, FL 32259.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a. Employees performing roofing work at elevations of six feet or more above the ground are not being protected from fall hazards by a fall protection system: The employer fails to assure effective protection against fall as required by the standard, as demonstrated on October 18, 2023, when four employees performing framing work on a new residential construction located at 7155 Mahogany Run Drive, lot 24, in Jacksonville, Florida, were exposed to the fall hazards,  in that employees did not use any fall protection system.    Ya Olivas Construction, Inc. was previously cited for a serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1655334, citation number 01, item number 002 and was affirmed as a final order on May 26, 2023, with respect to a workplace located at 394 Navigators Road, Jacksonville, FL 32259.  Ya Olivas Construction, Inc. was previously cited for a serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1646109, citation number 01, item number 001 and was affirmed as a final order on March 22, 2023, with respect to a workplace located at 9929 Intervention Lane, Lot 001, Jacksonville, FL 32256.
