29 CFR  1926.20(b)(1): The employer did not initiate and maintain programs necessary to ensure compliance with the Occupational Safety and Health Standards:        At the jobsite located at 5736 E. Bristol Street, Bel Aire, Kansas, employees were exposed to stuck-by, and fall hazards. Employees engaged in roofing activities were exposed to stuck-by, and fall hazards while using pneumatic nail guns, and working from heights greater than 6 feet above a lower level.  Employees were exposed in that the employer had not initiated, developed and maintained a comprehensive safety and health program with policy, hazard assessment, and work site rules which addressed hazards such as but not limited to fall protection, face/eye protection, and other hazards during roofing activities.

The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles:  At the jobsite located at 5736 E. Bristol Street Bel Aire, Kansas, employees were exposed to struck-by hazards. Employees engaged in roofing activities were exposed to struck-by hazards from not wearing eye protection while using pneumatic nail guns.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    At the jobsite located at 5736 E. Bristol Street, Bel Aire, Kansas, employees were exposed to fall hazards. Employees engaged in residential roofing activities were exposed to fall hazards of approximately 10 feet to the ground below in that fall protection was not utilized.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   At the jobsite located at 5736 E. Bristol Street, Bel Aire, Kansas, employees were exposed to fall hazards. Employees engaged in residential roofing activities, walking, and working on a 6:12 pitch roof, were exposed to fall hazards of approximately 10 feet from the eave of the residence to the ground below in that fall protection training was not provided.
