29 CFR 1960.8(d): The Agency did not require or maintain approved safety equipment: a) WELLTON I8 CHECKPOINT: The Border Patrol failed to ensure that the crash cushion sand barrels were properly positioned in front of the traffic barriers in accordance with the approved traffic control plan, exposing employees to struck-by hazards from motor vehicles. b) WELLTON I8 CHECKPOINT: The Border Patrol failed to require the use of portable speed bumps, exposing employees to struck-by hazards from motor vehicles. c) WELLTON I8 CHECKPOINT: The Border Patrol failed to maintain the ceramic rumble strips permanently affixed to the asphalt, exposing employees to struck by hazards from motor vehicles.

29 CFR 1904.39(a)(2):The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation, or the loss of an eye. BORDER PATROL YUMA SECTOR: On or about October 21, 2023, the employer failed to report the in-patient hospitalization within 24-hours of two employees who were struck by a motor vehicle while conducting inspections at Interstate 8 Checkpoint.
