29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  Employees engaged in framing operations located at 19816 Redwood Street, Gretna, Nebraska 68028, were exposed eye and face hazards in that employees were observed using pneumatic nail guns and saws without eye protection.  This was most recently documented on or about October 25th, 2023.

29 CFR  1926.503(a)(1):The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  Employees engaged in framing activities located at 19816 Redwood Street, Gretna, Nebraska 68028 were exposed to fall hazards in that an employee was not trained on how to use fall protection.  This was most recently documented on or about October 25th, 2023.

29 CFR  1926.1052(c)(1)(ii):Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stair rail system along each unprotected side or edge:  Employees engaged in framing activities located at 19816 Redwood Street, Gretna, Nebraska 68028 were exposed to fall hazards in that employees were using a stair system for access and egress to the 2nd level of the residential structure.  The stairwell system in use did not have hand rails.  This was most recently documented on or about October 25th, 2023.

Employees engaged in framing activities at 19816 Redwood Street, Gretna, Nebraska 68028,  were exposed to fall hazards in that employees were using a stairwell system for access and egress to the 2nd level of the residential structure.  The upper landing connected to the stair well system was not equipped with a guard rail system.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system.  The employer is failing to protect employees from fall hazards.  This was most recently documented on or about October 25th, 2023, at 19816 Redwood Street, Gretna, Nebraska 68028. Employees were observed conducting framing operations at height greater than 6ft without any apparent fall protection.   Rodriguez and Garcia Construction  LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1633533, citation number 1, item number 2and was affirmed as a final order on 2-8-23, with respect to a workplace located at 2817 Superior Drive, Papillion, NE 68046.
