29 CFR 1926.451(c)(2)(v): The employer used a forklift to support a scaffold platform without ensuring that the entire platform was attached to the forks and that the forklift was not moved horizontally while the platform was occupied: On or about May, 20, 2024, an employee engaged in residential construction activities at the Rodriguez & Garcia Construction, LLC construction site located at 10904 N 161st Ave, Bennington, Nebraska was exposed to a fall hazard while working from a scaffold platform that was elevated by a forklift. The employer failed to ensure the platform was attached and/or secured to the forks of the forklift by mechanical means that would prevent the platform from falling free of the forks. Rodriguez and Garcia Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.451(c)(2)(v), which was contained in OSHA inspection number 1633533, citation number 1, item number 1 and was affirmed as a final order on 2-8-23, with respect to a workplace located at 2817 Superior Drive, Papillion, NE 68046.

Rodriguez and Garcia Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1705800, citation number 2, item number 1, and was affirmed as a final order on 1-3-24, with respect to a workplace located at 19816 Redwood St, Gretna, NE 68046.
