29 CFR  1926.501(b)(14):Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.  On or about May 13th, 2025, employees engaged in framing operations located at 11152 Portage Road, Papillion, Nebraska 68046 were exposed to fall hazards in that employee was observed standing on the bottom plate of a wall opening.  The wall opening was 6 feet 3 inches wide and was 10 feet 2 inches from bottom of the opening to the ground below.

29 CFR  1926.451(c)(2)(v):Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied:  The employer is failing to protect employees from fall hazards.  On or about May 13th, 2025, employees engaged in framing operations were exposed to fall hazards in that employees were working from a platform that was lifted by multiple rough terrain forklifts.  The entire platform was not attached to the fork and the forklifts.  Instances of failure include:   A.) Genie GTH-842.  B.) JLG 101 44281.  Rodriguez & Garcia Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.451(c)(2)(v), which was contained in OSHA inspection number 1633533, citation number 1, item number 2 and was affirmed as a final order on 2-8-23, with respect to a workplace located at 2817 Superior Drive, Papillion, Nebraska 68046.  Rodriguez & Garcia Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.451(c)(2)(v), which was contained in OSHA inspection number 1749225, citation number 2, item number 1 and was affirmed as a final order on 9-30-24, with respect to a workplace located at 10904 North 161 Ave, Bennington, Nebraska 68007.

The employer is failing protect employees from fall hazards.  On or about May 13th, 2025, employees engaged in framing operations located at 1152 Portage Road, Papillion, Nebraska 68046 were exposed to fall hazards in that multiple employees were observed working on top of trusses at heights greater than 10 feet  without any form of fall protection in place.    Rodriguez & Garcia Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1749225, citation number 2, item number 2 and was affirmed as a final order on 9-30-24, with respect to a workplace located 10904 North 161st Ave, Bennington, Nebraska 68007.   Rodriguez & Garcia Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1705800, citation number 2, item number 1 and was affirmed as a final order on 1-3-24, with respect to a workplace located at 19816 Redwood Street, Gretna, Nebraska 68028.  Rodriguez & Garcia Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1633533, citation number 1, item number 2 and was affirmed as a final order on 2-8-23, with respect to a workplace located at 2817 Superior Drive, Papillion, Nebraska 68046.

29 CFR  1926.503(b)(1):The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.  On or about May 13th, 2025, the employer failed to provide written certification, upon request,  that he trained his employees on the use of fall protection prior to exposing employees to hazardous heights.
