29 CFR 1926.651(k)(2):Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: On or about October 25, 2023, where there was evidence found of a situation that could result in possible cave in, the competent person onsite failed to remove themselves from the hazardous area. The competent person was working in a trench located at 3711 Theota Ave Parma, OH 44134, 5.7-feet below the ground without the use of any protective systems.
