29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) as incorporated by reference under 1926.602(d): a) Building 5 - Meridian Walk at Princeton, West Windsor NJ: The employer did not ensure that the company worksite Foreman, who utilized a Skytrak Telehandler Rough Terrain Fork Truck at the worksite, had received training which included formal instruction, hands on and an evaluation with a written certification of completion, on or about 10/26/23. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a- Roof Of Structure - Building 5 - Meridian Walk at Princeton, West Windsor NJ: On or about 10/26/23 a worker was not protected from falling when walking and working from a residential structure's pitched roof while wearing full body harness that was not connected to an anchor with a lanyard or other approved means . As such, this worker was exposed to fall hazards up to and in excess of 31 feet 5 inches to the ground surface below.
