29 CFR 1910.147(c)(4)(ii): Procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, 29 CFR 1910.147(c)(4)(ii)(A), (c)(4)(ii)(B), (c)(4)(ii)(C) and (c)(4)(ii)(D):  c. On or about November 1, 2023, at location 3975 Tall Pine Drive, Plover, Wisconsin: the energy control procedure for the Line 2 Freezer (ID# 10019873) did not explain how to verify the Nitrogen pressure has bled off.  d. On or about November 1, 2023, at location 3975 Tall Pine Drive, Plover, Wisconsin: the energy control procedure for the Breader FF/M#1 (ID# 10019695) did not explain how to verify the Hydraulic pressure has bled off.  The note on the procedure says to follow manufacturer's instructions, rather than including those in the LOTO Procedure.  e. On or about November 1, 2023, at location 3975 Tall Pine Drive, Plover, Wisconsin: the energy control procedure for the Fryer 1(ID# 10019877) did not explain that the cross bar guards were to protect from gravity.  h. On or about November 1, 2023, at location 3975 Tall Pine Drive, Plover, Wisconsin: the energy control procedure for the Nex-Gem Rotary Former (ID# 10019948) did not explain the method of verification of deenergization for the step 5 P2 Pneumatic energy.

29 CFR 1910.147(f)(1)(ii): Testing or positioning of machines, equipment or components thereof. In situations in which lockout or tagout devices must be temporarily removed from the energy isolating device and the machine or equipment energized to test or position the machine, equipment or component thereof, the specified sequence of actions in (f)(1)(i) through (f)(1)(v) of this section shall be followed, including removing employees from the machine or equipment area in accordance with paragraph (e)(2) of this section.  On or about December 4, 2023, at location 3975 Tall Pine Drive, Plover, Wisconsin: while employees were performing testing or positioning of the Line 3 freezer (Serial: 1172 Model: M10TC), the employees were not removed from the equipment nor were alternative protections equivalent to lockout provided to prevent employee exposure to the caught in hazard of the spiral freezer.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.  On or about November 1, 2023, at location 3975 Tall Pine Drive, Plover, Wisconsin:  the employer did not provide one or more methods of machine guarding to protect the operator and other employees in the machine area in the following instances:  a) On or about December 11, 2023, Line 1 at the cheese grinder section, a rotating belt used to lift cheese blocks into the top of machine was not adequately guarded during operation to prevent entry into the machine, exposing employees to caught-in and rotating parts.    b) On or about December 11, 2023, Line 1 at the batter conveyor section, a conveyor belt used to move product through the machine was not adequately guarded during operation to prevent entry into the machine, exposing employees to caught-in and rotating parts.  Employees need to reach in this area to clear breading that falls through the cracks.   c) On or about December 11, 2023, Line 1 at the fryer filter section, a rotating chain conveyor was not adequately guarded during operation to prevent access, exposing employees to contact with moving parts.  d) On or about December 11, 2023, Line 1 at the case elevator section was not adequately guarded during operation to prevent access, exposing employees to contact with moving parts.  e) On or about February 13, 2023, Line 3 at the Bosch bagger 3, a conveyor belt used to move product from the machine through packaging was not adequately guarded during operation to prevent entry into the machine, exposing employees to caught-in and rotating parts.    f) On or about February 13, 2023, Line 3 at the Bosch bagger 2, a conveyor belt used to move product from the machine through packaging was not adequately guarded during operation to prevent entry into the machine, exposing employees to caught-in and rotating parts.    g) On or about February 13, 2023, Line 3 at the Bosch bagger 1, a conveyor belt used to move product from the machine through packaging was not adequately guarded during operation to prevent entry into the machine, exposing employees to caught-in and rotating parts.    h) On or about February 13, 2023, Line 3 at the Post Freeze Water Spray belt, a conveyor belt was not adequately guarded during operation to prevent entry into the machine, exposing employees to caught-in and rotating parts.    i) On or about February 13, 2023, Line 3 at the incline after the Post Freeze Water Spray Belt was not adequately guarded during operation to prevent entry into the machine, exposing employees to caught-in and rotating parts.    j) On or about February 13, 2023, Line 3  at the recirculation Conveyor, a conveyor belt was not adequately guarded during operation to prevent entry into the machine, exposing employees to caught-in and rotating parts.    k) On or about February 13, 2023, Line 3 at the Feed Conveyor to scale, a conveyor belt was not adequately guarded during operation to prevent entry into the machine, exposing employees to caught-in and rotating parts.
