OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees caused by unsafe racking systems: (a) 156 West Harrisburg Ave, Elizabethtown, PA; Blending Area by the Maintenance door - On or about October 4, 2023 the 5-tiered/5-sectioned Polly Racking was not marked for storage capacity and was also damaged on 4 of 6 vertical posts at the ground level which exposed employees to struck-by hazards. (b) 156 West Harrisburg Ave, Elizabethtown, PA; Blending Area by the Maintenance door - On or about October 4, 2023 the 5-tiered/5-section Polly Racking did not have locking pins or another means of preventing the upward movement of the shelves installed where palletized product was placed by employees operating powered industrial trucks which exposed employees to struck-by hazards. (c) 156 West Harrisburg Ave, Elizabethtown, PA; Blending Area by the Compressor Room door - On or about October 4, 2023 the 3-tiered rack was not anchored to the floor which exposed employees to struck-by hazards. (d) 156 West Harrisburg Ave, Elizabethtown, PA; Hallway outside the Packaging/Production room - On or about October 4, 2023 the rack which contained the forklift charging stations was not anchored to the floor which exposed employees to stuck-by hazards. (e) 156 West Harrisburg Ave, Elizabethtown, PA; Hallway outside the Packaging/Production room - On or about October 4, 2023, the shelving units of the 2-tiered racks in the hallway across from the battery charging station were not installed so that the shelves were level which exposed employees to struck by hazards. (f)156 West Harrisburg Ave, Elizabethtown, PA; Freezers 2 and 3 - On or about October 4, 2023 the blue and also the green horizontal cross members on the storage racks visible from the entrance were damaged, were not marked for storage capacity, and were also not anchored, which exposed employees to struck-by hazards.
