Employers shall select and require employees to use appropriate hand protection when employees' hands are exposed to hazards such as those from skin absorption of harmful substances; severe cuts or lacerations; severe abrasions; punctures; chemical burns; thermal burns; and harmful temperature extremes. On or about November 15, 2023, at location 3575 N. Main St. Oshkosh, WI 54901: Employees were not required to use employer provided personal protective equipment to change propane tanks on the forklifts, such as chemically resistant protective gloves.

On or about November 15, 2023, at location 3575 N. Main St. Oshkosh, WI 54901: employees were operating a Caterpillar sit down forklift (Model: GC40K, Serial: AT87A31924) with damage including, but not limited to, chunks of tire missing and tires that were pulling away from the rim.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. On or about November 15, 2023, at location 3575 N. Main St. Oshkosh, WI 54901: Forklifts were not being examined before being placed in service. Daily pre-operational inspections on forklifts were not being performed.
