29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: a) On or about 11/16/2023, at a roofing project located at 51 St. John's Parkside, Buffalo, New York; employees were replacing the roof of a repurposed church building with varying roof pitches, with the main roof having a 10 in 12 pitch. While subcontractor employees were on the roof, fall protection was not enforced, as employees were not always tied off when working on the roof. Employees were exposed to approximately 50 feet fall to the ground. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.503(a)(2): The employer did not assure that each employee had been trained, as necessary, by a competent person qualified in the following areas: (i) The nature of fall hazards in the work area; (ii) The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; (iii) The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used; (iv) The role of each employee in the safety monitoring system when this system is used; (v) The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; (vi) The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; (vii) The role of employees in fall protection plans; and, (viii) The standards contained in this subpart. a) On or about 11/23/2024 at a roofing project located at 51 St. John's Parkside Buffalo, New York; Buffalo Roofing LLC, as the controlling and correcting employer, did not train their project manager to identify and recognize deficiencies in the personal fall arrest systems, such as but not limited, lifelines knotted to rafters as anchorage points, employees not using Dee-ring as the tie off point, employees not wearing harnesses appropriately and employees not tying off while on the roof. ABATEMENT DOCUMENTATION REQUIRED
