29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a) 9 Cambridge Court, Lumberton NJ: The employer did not ensure that each worker who utilized Omni Quip Textron, Inc. Lull All-Terrain lifts at the worksite had received training which included formal instruction, hands on and an evaluation with a written certification of completion, on or about 12/14/23. On or about 12/14/23 the company worksite Foreman was operating an Omni Quip Textron, Inc. Lull All-Terrain lift to deliver framing materials to the worksite workers.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee use appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors or potentially injurious light radiation:  a- 9 Cambridge Court, Lumberton NJ:  A worker was exposed to struck by hazards when using an air nailer without eye or face protection.  Condition observed on or about 12/14/23.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    a- Left side of Structure, 9 Cambridge Court, Lumberton NJ: Workers were exposed to fall hazards, in excess of 14 feet 7 inches to the ground surface below, when walking and working at and near the unprotected edges of a residential structure's second floor while not using fall protection.  Condition observed on or about 12/14/23.  b- Front of Structure,  9 Cambridge Court, Lumberton NJ: A worker was exposed to fall hazards, in excess of 12 feet to the ground surface below, when walking and working at a a residential structure's second floor unprotected wall opening while not using fall protection.  Condition observed on or about 12/14/23.   First Line Construction, LLC. was previously cited for a Serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1566149, citation number 1, item number 3 and was affirmed as a final order on 08/11/22, with respect to a workplace located at 813 West Lea Boulevard, Wilmington DE.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
