29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms without the entire platform attached to the fork and the fork-lift:  (a) On January 02, 2024, at 2412 Dutton Circle SE in Mandan, North Dakota, four employees engaged in construction activities on a new residential construction were exposed to fall and struck by hazards while using a forklift platform to access upper levels.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure:   (a) On January 02, 2024 at 2412 Dutton Circle SE in Mandan, North Dakota, four employees were exposed to fall hazards greater than 6 feet while engaged in roofing sheathing activities at a project without utilizing fall protection systems.  Note: E P Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501 (b)13 , which was contained in OSHA inspection number 1608331, citation number 1, item number 1 and was affirmed as a final order on 09-01-2022, with respect to a workplace located at 3413 Gallatin Drive Bismarck, North Dakota.  Note: E P Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501 (b)13 , which was contained in OSHA inspection number 1552578, citation number 1, item number 1 and was affirmed as a final order on 02-16-2022, with respect to a workplace located at 1028 50th Avenue West in West Fargo, North Dakota.  Note: E P Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501 (b)13 , which was contained in OSHA inspection number 1449209, citation number 1, item number 1 and was affirmed as a final order on 01-08-2020, with respect to a workplace located at 6941 Majestic Loop in Lincoln, North Dakota.
