29 CFR 1910.212(a)(3)(ii): Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s): On or about January 11, 2024, Employees engaged in manufacturing activities in the Elbow Department at Southwark Metal Manufacturing Company located at 2073 North Radenmakers Way, Fremont, Nebraska were exposed to caught-in hazards in that the elbow machines' point of operation was not guarded to as to prevent a body part from entering the danger zone. Instances included but were not limited to the: a. On or about January 10, 2024, the guard on automatic elbow did not prevent employees from contacting the cutting and forming wheels and b. On or about January 11, 2024, the manual oval elbow machine was not guarded as to prevent employees from contacting rotating cutting and forming wheels.

29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section: On or about January 10, 2024, Employees engaged in equipment servicing and maintenance in the Elbow Department at Southwark Metal Manufacturing Company located at 2073 North Radenmakers Way, Fremont, Nebraska were exposed to struck-by and caught-in hazards in that the employer did not develop written procedures to control electrical, pneumatic, and hydraulic energy sources when implementing hazardous energy control on the automatic elbows.

29 CFR 1910.147(f)(1)(ii): Employees were not removed from the machine or equipment area in accordance with paragraph (e)(2) of this section during testing or positioning of machines, equipment or components thereof. On or about January 10, 2024, an employee engaged in equipment servicing and maintenance in the Elbow Department at Southwark Metal Manufacturing Company located at 2073 North Radenmakers Way, Fremont, Nebraska was exposed to struck-by and caught-in hazards in that the employer did ensure the employee troubleshooting the Elbow #1, Cleveland Tool and Machine Automatic Elbow Machine 345, model number CTM 345, serial number 345-05-220619 was removed from the point of operation either by the implementation of hazardous energy control (Lockout and/or Tag Out).
