29 CFR  1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  On or about February 23, 2024, and at times prior thereto, employees were exposed to hazardous noise levels without the administration of a continuing, effective hearing conservation program, exposing them to hazardous noise levels in the following instances (a-b):  a. At the flooring production, an employee was exposed to continuous sound levels of 91 dBA, equivalent to 141% of the allowable 100% dose for an 8-hour time-weighted average (TWA). Exposure was derived from a sample collected over 389 minutes, and zero-valve exposure was assumed from a 91-minute non-sampled period.  b. At the roofing (shingles) production, an employee was exposed to continuous sound levels of 87 dBA, equivalent to 90% of the allowable 50% dose for an 8-hour time-weighted average (TWA). Exposure was derived from a sample collected over 389 minutes, and zero-valve exposure was assumed from a 91-minute non-sampled period.
