29 CFR 1910.95(g)(5)(ii): Where mobile test vans were used to meet the audiometric testing obligation, the employer did not obtain a valid baseline audiogram within 1 year of an employee's first exposure at or above the action level:  On or about June 25, 2025, and at times prior thereto and thereafter, baseline audiograms were not obtained within one year for employees exposed to noise level exceeding the action levels in the following instances (a-b):  a. In the Floor Production area, baseline audiogram was not obtained for an employee exposed to the permissible exposure level (PEL) of 93 decibels, equivalent to 155% of the allowable 100% dose for an 8-hour time-weighted average (TWA). The exposure was derived from a sample collected over 432 minutes. This employee was originally exposed to PEL of 91 decibels, equivalent to 141% of the allowable 100% dose for an 8-hour TWA on or about February 23, 2024; and  b. In the Shingles Production area, baseline audiogram was not obtained for employee exposed to the action level (AL) of 88 decibels, equivalent to 80% of the allowable 50% dose for an 8-hour time-weighted average (TWA). The exposure was derived from a sample collected over 417 minutes. This employee was originally exposed to AL of 87 decibels, equivalent to 90% of the allowable 50% dose for an 8-hour TWA on or about February 23, 2024.

29 CFR  1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in in paragraphs (c) through (o), whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level  (TWA) of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:   On or about June 25, 2025, and at times prior thereto and thereafter, a written hearing conservation program was not developed and effectively implemented when employees were exposed to hazardous noise levels in the following instances (a-d):  a. In the floor production area, an employee was exposed to noise levels exceeding the permissible exposure level (PEL) of 93 decibels, equivalent to 155% of the allowable 100% dose for an 8-hour time-weighted average (TWA). The exposure was derived from a sample collected over 432 minutes;  b. In the Shingles Production area an employee was exposed to noise levels exceeding the action level (AL) of 88 decibels, equivalent to 80% of the allowable 50% dose for an 8-hour time-weighted average (TWA). The exposure was derived from a sample collected over 417 minutes;  c. In the Roof/Exterior Production area, an employee was exposed to noise levels exceeding the action level (AL) of 88 decibels, equivalent to 75% of the allowable 50% dose for an 8-hour time-weighted average (TWA). The exposure was derived from a sample collected over 417 minutes; and  d. In the Side Wall Production area an employee was exposed to noise levels exceeding the action level (AL) of 88 decibels, equivalent to 71% of the allowable 50% dose for an 8-hour time-weighted average (TWA). The exposure was derived from a sample collected over 413 minutes.  Legacy Housing Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.95(c)(1), which was contained in OSHA inspection number 1722985, Citation Number 1, Item number 1, and was affirmed as a final order on November 18, 2024, with respect to a workplace located at 4801 Mark IV Parkway, Fort Worth, TX 76106.
