1910.9(a) Personal protective equipment. Standards in this part requiring the employer to provide personal protective equipment (PPE), including respirators and other types of PPE, because of hazards to employees impose a separate compliance duty with respect to each employee covered by the requirement. The employer must provide PPE to each employee required to use the PPE, and each failure to provide PPE to an employee may be considered a separate violation. In the Fabrication Area, employee(s) were exposed to eye and face injuries in that the Employer did not update it's personal protection equipment hazard assessment to include requiring employee(s) to use eye and face protection.

29 CFR 1910.132(d)(1)(ii):The employer did not communicate personal protection equipment selection decision(s) to each affected employee: In the Fabrication Area, employee(s) are exposed to eye and face injuries in that the employer did not communicate personal protection equipment selection decision(s) to each affected employee. Multiple employees were not wearing eye protection with the presence and use of cutting knives and meat hooks. Employees were instructed not to wear eye and face protection but were not informed what the reasoning and decision was by the employer . This resulted in an employee sustaining an eye injury to the cornea and eyelid.

29 CFR 1910.132(d)(2):The employer did not verify, through a written certification, that the required workplace hazard assessment had been performed: In the Fabrication Area, employees engaged in meat harvest and meat processing activities were exposed to laceration and amputation hazards while utilizing meat cutting knives, meat hooks, and large and small saws used for the breakdown of carcasses and smaller parts of the carcass. The employer did not verify through a written certification that all areas of the facility had been assessed for proper PPE.
