29 CFR 1910.212(a)(3)(ii): Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s): a.) Lincoln Recycling, Inc.- On or about 2/15/24, and at times prior thereto, machine guarding was not installed around the point of operation on the Alligator Shear, (model #1.5x18, serial#7303).An employee sustained a fingertip amputation when operating the shear to cut metal. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR 1910.212(a)(3)(iii):Special hand tools for placing and removing material(s) was not provided to permit easy handling of material without the operator placing a hand in the danger zone: a.) Lincoln Recycling, Inc.- On or about 2/15/24, and at times prior thereto, the company had not provided hand tools for use while placing parts in the shear. An employee sustained a fingertip amputation when his finger was caught between the saw blade cutting area. The part was placed in the shear, close to the cutting blade, to remove the copper from the other metal on the part. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.
