29 CFR  1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.   (a) Molondros Roofing LLC, failed to document abatement within 10 calendar days after the abatement date that the following cited violation had been corrected:  Citation 1, Item 1 a Serious violation of 29 CFR 1926.20(b)(2) with an abatement date of  May 20, 2024.  Citation 1, Item 2 a Serious violation of 29 CFR 1926.102(a)(1) with an abatement date of  May 1, 2024.  Citation 2, Item 1 a Repeat Serious violation of 29 CFR 1926.501(b)(13) with an abatement date of  May 1, 2024.  Citation 2, Item 2 a Repeat Serious violation of 29 CFR 1926.1053(b)(1) with an abatement date of  May 1, 2024.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

29 CFR  1926.20(b)(2):The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s).  (a) On or about March 12, 2024, at a jobsite located at N118W7264 Fairway Lane, Cedarburg, WI 53012, the employer did not perform frequent and regular inspections of the job site to ensure that hazardous conditions were identified and corrected.

29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  (a) On or about March 12, 2024, at a jobsite located at N118W7264 Fairway Lane, Cedarburg, WI 53012, employees were operating pneumatic nail guns without eye protection while installing shingles on the roof of a new residential home. This exposed employees to a struck by hazard and eye impalement injury.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  (a) On or about March 12, 2024, at a jobsite located at N118W7264 Fairway Lane, Cedarburg, WI 53012, employees installing shingles on an approximately 9:12 pitch roof  were not wearing fall protection. This exposed employees to a fall hazard of approximately 28feet from roof to the ground below.  Molondros Roofing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1631503, citation number 1, item number 1 and was affirmed as a final order on April 4, 2023, with respect to a workplace located at 311 E. Fernwood Lane, Appleton, WI 54913.  Molondros Roofing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(1), which was contained in OSHA inspection number 1689809, citation number 2, item number 1  and was affirmed as a final order on December 7, 2023, with respect to a workplace located at 6220 University Ave, Middleton, WI 53562.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.  (a) On or about March 12, 2024, at a jobsite located at N118W7264 Fairway Lane, Cedarburg, WI 53012, employees were using a ladder on the right front of the house to access the roof which did not exceed 3 feet past the landing area, therefore exposing employees to a fall hazard greater than six feet.  Molondros Roofing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(1), which was contained in OSHA inspection number 1689809, citation number 1, item number 1  and was affirmed as a final order on December 7, 2023, with respect to a workplace located at 6220 University Ave, Middleton, WI 53562.
