(b) Citation 1, Item 2, a Serious violation of 29 CFR 1926.503(a)(1) with an abatement date of October 16, 2024.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

29 CFR  1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s)  (a) On or about September 4, 2024, the employer did not ensure frequent and regular inspections of the jobsite were conducted by a competent person to ensure hazardous conditions were found and corrected. Hazards identified included but were not limited to: Fall protection not being worn and unsafe use of a multipurpose ladder for access and egress from a residential roof.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards.  (a) On or about September 4, 2024, the employer did not ensure that employees exposed to potential fall hazards had been trained to recognize and minimize the fall hazards associated with their work. This exposed employees to a fall hazard of approximately 8.5 feet from the east side of the residential roof onto the concrete driveway.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  (a) On or about September 4, 2024, employees conducting roofing work on an existing residential roof with a 5:12 pitch, were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately 8.5 feet onto the concrete driveway.  Molondros Roofing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(1), which was contained in OSHA inspection number 1689809, citation number 2, item number 1  and was affirmed as a final order on December 7, 2023, with respect to a workplace located at 6220 University Ave, Middleton, WI 53562.  Molondros Roofing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1631503, citation number 1, item number 1 and was affirmed as a final order on April 4, 2023, with respect to a workplace located at 311 E. Fernwood Lane, Appleton, WI 54913.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.  (a) On or about September 4, 2024, the employer did not ensure the multipurpose ladder used by employees to access the residential roof extended at least three feet above the upper landing, exposing employees to a fall hazard of 8.5 feet to the ground below.
