Pre-Treatment Area - On or about March 14, 2024, the employer failed to provide suitable personal protective equipment (PPE), such as rain boots, to protect workers from slips and falls on wet surfaces and chemical splashes while foaming and spraying with diluted and concentrated Morado Super Cleaner Extra Heavy-Duty Industrial Cleaner and Degreaser.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use. a. On or about March 14, 2024, employees working in the pre-treatment and wash bay area were required to work with injurious corrosive chemicals including, but not limited to, Morado Super Cleaner Extra Heavy-Duty Industrial Cleaner & Degreaser. Employees were exposed to skin and eye burns when a safety shower and eyewash were not available for immediate emergency use that provided a minimum supply of 20 gallons of water per minute for at least 15 minutes.

29 CFR 1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical. a. Pre-Treatment/ Wash Area/Drying Area - On or about March 14, 2024, the employer did not ensure that each secondary container containing Morado Super Cleaner Extra Heavy-Duty Industrial Cleaner & Degreaser and CitraFlor OTS was properly labeled, tagged or marked with product identifiers and its associated hazards, thereby exposing employees to serious health hazards associated with Morado Super Cleaner Extra Heavy-Duty Industrial Cleaner & Degreaser.
