29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  A continuing, effective hearing conservation program (including the elements of noise monitoring, employee notification, audiometric testing, hearing protection, training, information, and recordkeeping) was not administered for instances such as, but not limited to:  a) On March 29, 2024, an employee operating a forklift in the front of the facility was exposed to noise at 119.7% of the permissible daily dose, or an average sound level of 92.1 dBA, as measured over 429 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 91.3 dBA accounting for the period of 51 minutes unmonitored.  b) On March 29, 2024, an employee conducting washing operations was exposed to noise at 153.9% of the permissible daily dose, or an average sound level of 93.6 dBA, as measured over 442 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 93.1 dBA accounting for the period of 38 minutes unmonitored.  c) On March 29, 2024, an employee conducting washing operations was exposed to noise at 130.6% of the permissible daily dose, or an average sound level of 92.6 dBA, as measured over 434 minutes of sampling.  This dose is equivalent to an 8-hour TWA exposure of 91.9 dBA accounting for the period of 46 minutes unmonitored.  d) On March 29, 2024, an employee conducting washing operations was exposed to noise at 114.2% of the permissible daily dose, or an average sound level of 91.8 dBA, as measured over 424 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 91.0 dBA accounting for the period of 56 minutes unmonitored.  e) On March 29, 2024, an employee conducting washing operations was exposed to noise at 79.4% of the permissible daily dose, or an average sound level of 90.4 dBA, as measured over 356 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 88.3 dBA accounting for the period of 124 minutes unmonitored.  f) On March 29, 2024, an employee conducting washing operations was exposed to noise at 133.1% of the permissible daily dose, or an average sound level of 92.8 dBA, as measured over 429 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 92.1 dBA accounting for the period of 51 minutes unmonitored.
