29 CFR  1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s).  On or about March 18, 2024, during traffic control operations located at or near 5610 Wilson Mills Rd., Highland Heights, OH, 44143, the employer did not conduct frequent and regular inspections of the job site where employees were improperly flagging traffic, exposing the employees to struck-by hazards.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury.  On or about March 18, 2024, employees were exposed to struck-by hazards at or near 5610 Wilson Mills Rd., Highland Heights, OH, 44143 while performing an incorrect flagging zone on a multilane highway, where the adjacent roadway did not have adequate traffic control devices in accordance with the MUTCD part 6, to provide protection for traffic and workers and where the employer failed to provide employees with a traffic control plan or typical application.

29 CFR 1926.200(g)(1): Construction areas were not posted with legible traffic signs at points of hazards.  On or about March 18, 2024, at or near 5619 Wilson Mills Rd., Highland Heights, OH, 44143, workers directing traffic from within the traveled way were not protected from struck-by hazards where a traffic lane was closed without the use of advance warning signs, including lane closure signs.

29 CFR  1926.201(a): Signaling by flaggers and the use of flaggers, including warning garments worn by flaggers did not conform to Part VI of the Manual on Uniform Traffic Control Devices, (1988 Edition, Revision 3 or the Millennium Edition).  On or about March 18, 2024, the employer did not ensure employees directing traffic at or near 5610 Wilson Mills Rd., Highland Heights, OH, 44143 were protected from struck-by hazards, in that, the workers directing traffic were flagging from within the traveled way and were not using a stop/slow paddle, flag, or automated flagger assistance device as required per the MUTCD section 6E.07 and were not at flagger stations required by the MUTCD section 6E.08

29 CFR  1926.200(g)(2): Traffic control signs or devices used for protection of construction workers did not conform to Part VI of the Manual of Uniform Traffic Control Devices (AMUTCD"), 1988 Edition, Revision 3, September 3, 1993, FHWA-SA-94-027 or Part VI of the Manual on Uniform Traffic Control Devices, Millennium Edition, December 2000, FHWA.  On or about March 18, 2024, employees were exposed to struck-by hazards at or near 5610 Wilson Mills Rd., Highland Heights, OH, 44013, where the employer did not have the following traffic control signs or devices in use to protect the crew that had one out of two lanes of traffic closed for an excavation in an active temporary construction zone per 6H-33 and 6F.61 of the MUTCD:  a) The employer did not ensure advanced warning signs used for traffic control were properly placed for a right lane closure on a multilane highway, per the MUTCD.  b) The employer did not ensure traffic control devices used for traffic control were properly placed for a right lane closure on a multilane highway, per the MUTCD  c) The employer did not ensure an arrow board used for traffic control was utilized for a right lane closure on a multilane highway, per the MUTCD.  d) The employer did not ensure an adequate merging taper was installed for a single lane closure on a multilane highway, per the MUTCD, exposing employees to struck-by hazards.  AWP, Inc. DBA AWP Safety was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.200(g)(2), which was contained in OSHA inspection number #1677539, citation number 1, item number 1 and was affirmed as a final order on 1/18/2024, with respect to a workplace located at 15707 N. Expressway 281 EDINBURG, TX, 78541.
