29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person:  (a)Rhino Roofing, LLC at 1101 North Career Avenue, Sioux Falls, SD 57107: On or about and at times prior to March 28, 2024, the exposing employer did not ensure that frequent and regular inspections were conducted by a competent person. This condition exposed employees to various hazards such as fall hazards, lack of safety lines and a lack of training.

29 CFR  1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system:  (a)Rhino Roofing, LLC at 1101 North Career Avenue, Sioux Falls, SD 57107: On or about and at times prior to March 28, 2024, the exposing employer did not ensure that employees were protected from falls while conducting roofing operations on a commercial property due to the lack of adequate fall protection systems in place.  This condition exposed employees to fall hazards greater than 25 feet.

29 CFR 1910.178(l)(6): The certification did not include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation:  (a)Rhino Roofing, LLC at 1101 North Career Avenue, Sioux Falls, SD 57107: On or about and at times prior to March 28, 2024, the employer did not ensure that a written certification/ evaluation was conducted prior to employees utilizing the Genie GTH-844, Model 226813, telehandler on site.  This condition exposed employees to injuries associated with improper powered industrial truck operations.
