29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) and as referenced by the note contained in 1926.602(d):  a) Jobsite located at or near Pietro Way and Palermo Drive, Philadelphia, PA 19145- On or about April 4, 2024, the employer did not ensure that the powered industrial truck (PIT) operator operating PITs such as, but not limited to, the JLG telehandler successfully completed training and evaluation to ensure the operator has the knowledge and skills needed to operate the powered industrial trucks safely, thereby exposing employees to caught in-between and fall hazards.  Training shall consist of a combination of formal instruction, practical training, and evaluation of the operator's performance in the workplace.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by a guardrail system, safety net system, or personal fall arrest system, or an alternative fall protection measure that meets a provision described in paragraph (b) of this section:  a) Jobsite located at or near Pietro Way and Palermo Drive, Philadelphia, PA 19145- On or about April 4, 2024, the employer did not ensure that an employee was protected by a guardrail system, safety net system, or personal fall arrest system, or an alternative fall protection measure during residential construction activities approximately 12.5 feet above ground level. An employee was installing plywood on the exterior of the building while standing on a platform attached to the forks of a telehandler without fall protection, thereby exposing the employee to fall hazards.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards:  a) Jobsite located at or near Pietro Way and Palermo Drive, Philadelphia, PA 19145- On or about April 4, 2024, the employer did not provide effective training to an employee who was exposed to fall hazards during residential construction activities, thereby exposing an employee to falls of approximately 12.5 feet. An employee installed plywood to the exterior of a residential building while standing on a platform attached to the forks of a telehandler, thereby exposing the employee to fall hazards.

29 CFR 1926.602(c)(1)(viii)(A): The industrial truck was not equipped with a safety platform/cage firmly secured to the lifting carriage and/or forks when used for lifting personnel:  a) Jobsite located at or near Pietro Way and Palermo Drive, Philadelphia, PA 19145- On or about April 4, 2024, the employer did not ensure the platform was secured to the forks when used for lifting an employee. The employer directed an employee to install plywood on the exterior of a residential building while standing on a platform that was not firmly secured to a telehandler, thereby exposing the employee to a fall of approximately 12.5 feet.
