29 CFR 1926.451(f)(3):Scaffolds and scaffold components shall be inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity.  a) On or about April 14, 2024, the employer did not ensure the form scaffold components that were installed in tank 1 at the 1400 Dye Mill Rd Troy, OH location were inspected for visible defects by a competent person in that one of the braces was corroded and broken and no mid rail was put up.

29 CFR 1926.451(b)(1):Each platform on all working levels of scaffolds shall be fully planked or decked between the front uprights and the guardrail supports as follows:  (b)(1)(i) Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) shall be installed so that the space between adjacent units and the space between the platform and the uprights is no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary (for example, to fit around uprights when side brackets are used to extend the width of the platform).  a) On or about April 16, 2024 the employer did not ensure the form scaffold installed in tank 1 was fully planked while employees were standing on the scaffold installing concrete forms in that there was a gap of more than 1 inch on form side and upright side of the scaffold exposing them to fall hazards of approximately 8 feet.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a) On or about April 29, 2024, the employer did not adequately protect employees from falls in that the ladder in tank 1 mixer 1 was configured to prevent employees from stepping through the job made ladder to step 15" across the edge of the tank exposing employees to a fall height of approximately 15 feet into the tank while getting on and off of the extension ladder placed between the job made ladder.  b) On or about April 29, 2024, the employer did not adequately protect employees from falls in that the ladder in tank 1 mixer 2 was configured to prevent employees from stepping through the job made ladder to step 15" across the edge of the tank exposing employees to a fall height of approximately 15 feet into the tank while getting on and off of the extension ladder placed between the job made ladder.  c) On or about April 29, 2024, the employer did not adequately protect employees from falls in that the ladder in tank 1 mixer 3 was configured to prevent employees from stepping through the job made ladder to step 15" across the edge of the tank exposing employees to a fall height of approximately 15 feet into the tank while getting on and off of the extension  ladder placed between the job made ladder.
