29 CFR 1926.1153(c)(1): Specified exposure control methods. For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. a.) On or about April 25th and 26th, 2024, the employer failed to provide employees drilling holes in the concrete floor of Treatment Tanks #1 with a rotary hammer drill equipped with commercially available shroud or cowling with dust collection system, and did not assess the exposure limits of the employees to respirable crystalline silica. Employees used a handheld Hilti TE 4-A22 rotary hammer drill without a dust collection system to drill 40 holes for installation of anchors for air diffusers in Treatment Tank #1.

29 CFR 1926.1203(a): Before it begins work at a worksite, each employer must ensure that a competent person identifies all confined spaces in which one or more of the employees it directs may work, and identifies each space that is a permit space, through consideration and evaluation of the elements of that space, including testing as necessary. a.) On or about April 25th and 26th, 2024, the employer failed to properly identify Treatment Tank #1 as a permit required confined space and did not ensure employees entering the tank to drill 40 holes in the concrete floor for installation of anchors for air diffusers followed permit required confined space entry procedures or completed a certification for reclassification of the permit required confined space prior to entering the tank.

On or about April 25th and 26th, 2024, the employer did not provide the information contained in Appendix D to employees voluntarily wearing 3M 8210 N95 filtering facepiece respirator while working in Treatment Tank #1 drilling holes in the concrete floor for installation of anchors for air diffusers.
