29 CFR  1926.300(a): Hand tools, power tools or similar equipment were not maintained in a safe condition:  (a)Stone Hill Excavation, LLC at 351 South Douglas Street, Salem, SD 57058:  On or about and at times prior to April 22, 2024, the employer did not ensure adequate guarding was installed on a STIHL TS 4202 portable cutting saw that was being used to cut sewer pipe for sewer pipe installation in that the existing guard was damaged.  This condition exposed employees to caught-in hazards associated with exposure to a damaged cutting wheel guard.

29 CFR  1926.300(b)(2): Moving parts of equipment exposed to contact by employees or which otherwise created a hazard, were not guarded:  (a)Stone Hill Excavation, LLC at 351 South Douglas Street, Salem, SD 57058:  On or about and at times prior to April 22, 2024, the employer did not ensure that guarding was installed on a  portable cutting saw that was being utilized for the use of cutting sewer pipe in that the belt and flywheel were not guarded.  This condition exposed employees to caught-in hazards associated with the unguarded belt and flywheel on the saw.

This condition exposed employees to cave-in and crushing hazards associated with inadequate egress.

(a)Stone Hill Excavation, LLC at 351 South Douglas Street, Salem, SD 57058:  On or about and at times prior to April 22, 2024, the employer did not ensure employees conducting sewer pipe connection and installation within an unprotected excavation greater than five feet in depth were adequately protected from trench wall cave-in.  This condition exposed employees to struck-by and cave-in hazards associated with a trench wall collapse.
