29 CFR 1926.300(a): Hand tools, power tools or similar equipment were not maintained in a safe condition: (a)Stone Hill Excavation, LLC at Center Avenue and Gilbert Avenue, Salem, SD 57058: On or about and at times prior to July 17, 2024, the exposing employer did not ensure adequate guarding was installed on a STIHL TS 4202 portable cutting saw that was being used to cut sewer pipe for sewer pipe installation in that the existing guard was damaged. This condition exposed employees to caught-in hazards.

29 CFR 1926.300(b)(2): Moving parts of equipment exposed to contact by employees or which otherwise created a hazard, were not guarded: (a)Stone Hill Excavation, LLC at Center Avenue and Gilbert Avenue, Salem, SD 57058: On or about and at times prior to July 17, 2024, the employer did not ensure that guarding was installed on a portable cutting saw that was being utilized for the use of cutting sewer pipe in that the belt and flywheel were not guarded. This condition exposed employees to caught-in hazards.
