29 CFR  1926.100(a):Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets.  Location: Worksite  On or about May 29, 2024, employees were exposed to struck- by hazards while performing framing activities, where the employer did not ensure that employees were using protective helmets. The employer failed to ensure that head protection was being used employees, even though hard hats were available on site.

Location: Worksite  On or about May 29, 2024, employees were exposed to struck-by hazards from flying debris while performing framing activities where the employer did not ensure that employees used impact resistant eye protection while working on site, and operating pneumatic nail guns, saws, and other tools, even though eye protection was available on site.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  Location: Worksite  a) No fall protection in place on the roof at the front of the property: On or about May 29, 2024 employees were exposed to fall hazards up to an estimated 20 feet while performing framing activities, where the employer did not ensure that fall protection was in place, by any means.  b) Unguarded windows on 2nd level of project, on front, side, and back of building:  On or about May 29, 2024, employees were exposed to fall hazards of an estimated 15 feet where windows were not guarded and the inside bottom edge of the window was less than 39 inches.  c) Unguarded oversized window on 1st level, back of home: On or about May 29, 2024, employees were exposed to fall hazards of over 8 feet where a window was not guarded and the inside bottom edge of the window was less than 3 inches.  The employer has previously failed to ensure that employees were protected by fall protection, as seen in prior OSHA inspection:  a) OSHA previously issued a citation alleging an other-than-serious violation of this occupational safety and health standard or equivalent standard, 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1646750, citation number 2, item number 1 and was affirmed as a final order on 1/22/2024 to the employer, with respect to a workplace located at 7 Lilac Ave., Bellingham, MA 02019 where an employee fell over 11 feet from the roofline.
