29 CFR 1926.100(a):Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets. a) On or about 05/17/24, at 3 University Commons, (RIT Campus Housing) in Rochester, New York, the employer did not enforce the use of head protection (hard hat), for employees working under a roof "tear off" and installation project, where roofing materials were falling to the ground level. Employees were allowed to collect and pickup scrap roofing materials for disposal during the roof tear off. Employees were exposed to overhead hazards. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems with toe boards, safety net systems, or personal fall arrest systems. a) On or about 05/17/24, at 3 University Commons, (RIT Campus Housing) in Rochester, New York , the employer did not enforce the use of fall protection, for employees involved in a roof "tear off" and roof installation 20 feet above lower levels. Employees were allowed to perform roofing work, including a roof tear off and installation, without fall protection, exposing them to fall hazards. NO ABATEMENT CERTIFICATION REQUIRED
