29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   The employer does not protect each employee from fall hazards while performing roofing activities on residential structures with unprotected sides and edges at height of approximately 9  feet above the ground by the use of guard rail systems, safety net systems, and or personal fall arrest systems. This most recently occurred on June 17, 2024, during the installation of roofing material at a job site located at 319 Elmwood Ave., Bay Village, OH; the employer did not ensure that all employees working on the roof of a single family home were protected from a fall of approximately 9 feet by utilizing a fall protection system.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  The employer does not protect each employee from fall hazards while ascending and descending potable extension ladders in that, the side rails of the ladder do not extend at least 3 feet above the landing surface. This most recently occurred on June 17, 2024, during the installation of roofing material at a job site located at 319 Elmwood Ave., Bay Village, OH; the employer did not ensure that portable extension ladders used on site extended at least 3 feet above the upper landing surface.  Velazquez Construction was previously cited for a violation of this occupational safety and health standard  1926.1053 (b)(1) Ladders, which was contained in OSHA inspection number 1712556, citation number 1, item number 2 and was affirmed as a final order on February 24, 2024, with respect to a workplace located at 1431 Schneider ST NE, North Canton, OH 44720.  Velazquez Construction was previously cited for a violation of this occupational safety and health standard  1926.1053 (b)(1) Ladders, which was contained in OSHA inspection number 1567781, citation number 1, item number 2 and was affirmed as a final order on January 19, 2022, with respect to a workplace located at 3014 Copley Road, Copley, OH 44321.
