29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a)Argueta Construction, LLC at 102 East Venture Place, Tea SD 57064:  On or about and at times prior to June 15, 2024, the exposing employer did not ensure an employee was trained and evaluated prior to operating the Ingersoll Rand telehandler, Model:  VR-642O, Serial: 178052 on site. This condition exposed employees to struck-by and crushing hazards due to the lack of training.  b)Argueta Construction, LLC at 102 East Venture Place, Tea SD 57064:  On or about and at times prior to June 15, 2024, the exposing employer did not ensure an employee was trained and evaluated prior to operating the Skyjack telehandler, model: VR843D, Serial: 87100169 on site. This condition exposed employees to struck-by and crushing hazards due to the lack of training.

29 CFR  1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level:  a)Argueta Construction, LLC at 102 East Venture Place, Tea SD 57064:  On or about and at times prior to June 15, 2024, the exposing employer did not ensure that employees were protected from fall hazards while utilizing a rough terrain forklift to lift a bunk of plywood while an employee stood on the material being placed on the roof.  This condition exposed an employee to a fall hazard greater than 10 feet.

The attachment point of the body harness was not located in the center of the wearer's back near shoulder level, or above the wearer's head:  a)Argueta Construction, LLC at 102 East Venture Place, Tea SD 57064:  On or about and at times prior to June 15, 2024, the exposing employer did not ensure that an employee was properly wearing fall protection equipment while performing framing operations. The attachment point of the body belt was not located in the center of the employee's back and was observed near the right side of his body near their waist. This condition exposed the employee to bodily harm in the event of a fall.
