29 CFR  1926.1153(c)(1):Specified exposure control methods. For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  On or about July 9th, 2024 at 1080 South Main Street, Bowling Green, OH 43402 K & K Construction of Weston, Ohio, LLC, failed to implement engineering controls, work practices, and respiratory protection specified for the task in Table 1 while employees were actively using a Core Cut CC1200xl concrete saw to perform exterior concrete work with no dust collection system and no water delivery system as specified in Table 1 exposing employees to respirable crystalline silica hazards.
