29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: On or about July 2024, a continuing, effective hearing conservation program, including noise monitoring and training, was not implemented in the workplace to determine if employee exposure exceeded the 8-hour time-weighted average of 85 decibels. a) On July 24, 2024, the mini cone line operator #1 working near the cartoner machine near the end of the line was exposed to noise at 138% of the permissible daily dose, or an average sound level of 94 dBA, as measured over 374 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 92 dBA accounting for the period of 106 minutes unmonitored. b) On July 24, 2024, the mini cone line operator #2 working towards the beginning of the line was exposed to noise at 92% of the permissible daily dose, or an average sound level of 90 dBA, as measured over 439 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 89 dBA accounting for the period of 41 minutes unmonitored. c) On July 24, 2024, the scrounds line operator #1 working with the R-Packer was exposed to noise at 102% of the permissible daily dose, or an average sound level of 90 dBA, as measured over 458 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 90 dBA accounting for the period of 22 minutes unmonitored.
