29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):  At the temporary jobsite located at 18224 Depot Street, Overland Park Kansas, employees engaged in residential framing activities were exposed to fall hazards of approximately 12 feet from the trusses to the ground below in that fall protection was not utilized.  The Marco Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1705103, citation number 1, item number 2 and was affirmed as a final order on 03-22-2024, with respect to a workplace located at 2005 W Dennis Ave, Olathe, KS 66061. 29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  At jobsite located at 18224 Depot Street, Overland Park Kansas, employees engaged in residential framing activities were exposed to fall hazards of approximately 12 feet from the eave of the residence to the ground below while accessing and exiting the trusses in that the ladders did not extend at least 3 feet above the upper landing and was not secured to the residence/structure. 29 CFR  1926.1053(b)(13):The top or top step of a stepladder was used as a step:  At jobsite located at 18224 Depot Street, Overland Park Kansas, employees engaged in residential framing activities were exposed to fall hazards of approximately 6-9 feet from the top ladder, or the upper landing level of the residence to the ground below while accessing and exiting the trusses in that the top of the portable A-frame ladders were used as a step to access the trusses. The orange ladder was set up improperly by leaning against the trusses.
