29 CFR  1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  (a) Javier Lopez DBA Javier Lopez, failed to document abatement within 10 calendar days after the abatement date that the following cited violation had been corrected:  Citation 1, Item 1 a Serious violation of 29 CFR 1926.501(b)(13) with an abatement date of  August 20, 2024.  Citation 1, Item 2 a Serious violation of 29 CFR 1926.1053(b)(1) with an abatement date of  August 20, 2024.  Citation 2, Item 1 a Other-Than-Serious violation of 29 CFR 1926.503(b)(1) with an abatement date of  September 9, 2024.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  (a) On or about July 17, 2024, at 588 East Randy Rd, Oak Creek, WI 53154, employees installing a roof on a new residential home with an approximately 7:12 pitch were not using fall protection. This exposed employees to a fall hazard of approximately 18 feet 4 inches from the roof eve to the ground below on the back (North) side of the home.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.  (a) On or about July 17, 2024, at 588 East Randy Rd, Oak Creek, WI 53154, employees were accessing the roof to conduct roofing work from a ladder at the front of the home which did not extend at least three (3) feet above the upper landing surface, exposing employees to a fall hazard of approximately 17 feet 9 inches.

(a) On or about July 17, 2024, at 588 East Randy Rd, Oak Creek, WI 53154, the employer did not verify fall protection training by preparing a written certification record for employees tasked with installing a roof on a new residential home.
