29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59) At the job site located at 22510 West 60th St., Shawnee, Kansas, employees engaged in roofing activities were exposed to chemical hazards in that a written hazard communication program had not been developed, implemented and maintained at the job site. Employees were handling Malarkey Roofing Products Vista AR polymer modified asphalt fiberglass shingles, TRI-BUILT hybrid construction sealant, TRI-BUILT roof accessory paint and gasoline. The chemical hazards associated with these chemicals include: skin, eye and respiratory irritation, may cause an allergic skin reaction, drowsiness and/or dizziness, central nervous system (CNS) depression, is suspected of causing cancer and may be fatal if swallowed and enters airways. Additionally, TRI-BUILT roof accessory paint and gasoline can both act as a fueling agents due to their extreme flammability as a liquid and vapor.

29 CFR 1910.1200(g)(8): The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical: (Construction Reference: 1926.59) At the job site located at 22510 West 60th St., Shawnee, Kansas, employees engaged in roofing activities were exposed to chemical hazards in that they were not provided access to the Safety Data Sheets (SDSs) for Malarkey Roofing Products Vista AR polymer modified asphalt fiberglass shingles, TRI-BUILT hybrid construction sealant, TRI-BUILT roof accessory paint and gasoline at the job site.
